GENERAL TERMS AND CONDITIONS (CONDICIONES GENERALES DE CONTRATACIÓN)

1. Legal Identification (LSSI-CE Compliance)

In compliance with Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the following identifying data of the business owner are set out:

2. Object of the Contract

These General Terms and Conditions regulate the purchase of digital products and services offered on Stefbastian.com. Currently, we offer:

• Automated Painting Video Courses: Pre-recorded digital content accessed immediately upon purchase.

• 6-Month Mentorship Program: A hybrid service combining recorded educational material with live online coaching, personalised feedback and ongoing support.

3. Purchase Process

In accordance with Spanish consumer law, the purchasing process is conducted in English. The user must select the desired product or program, complete the checkout process by providing the requested billing data, and make the payment through our designated secure payment gateways (e.g., Stripe, PayPal). The contract is formalized the moment the payment is successfully processed. A confirmation email will be sent within 24 hours of purchase, serving as proof of the transaction.

4. Pricing and Taxes

All prices are indicated in Euros. Prices may be displayed either inclusive or exclusive of Value Added Tax (VAT / IVA), as expressly indicated on the relevant product or service page.

VAT will be applied where required by applicable tax law. Where VAT is not chargeable, including where the customer qualifies for a VAT exemption or where the reverse-charge mechanism applies, no VAT will be charged.

The applicable price, VAT treatment and total amount payable will be shown to the customer before the purchase is completed.

We reserve the right to modify prices at any time; however, purchases will be charged at the price applicable at the time the order is placed.

5. Access and Delivery of Digital Content

• Painting Courses: Access to the digital video courses is granted automatically and immediately upon successful payment.

• Mentorship Program: Access to the recorded materials on the Tevello platform and instructions for scheduling live calls will be provided upon receipt of the initial deposit or full payment. You retain lifetime access to the recorded Tevello content after the 6-month program concludes.

6. Right of Withdrawal and Refund Policy (TRLGDCU Compliance)

• For Automated Painting Video Courses (Digital Content):

In accordance with Article 103(m) of the Spanish General Law for the Defense of Consumers and Users (TRLGDCU), the 14-day legal right of withdrawal does not apply to the supply of digital content not provided on a tangible medium once its execution has begun. By purchasing our automated painting video courses, you expressly consent to gaining immediate access to the digital content and acknowledge that you will lose your legal right of withdrawal from the contract the moment access is granted. Consequently, all sales of automated painting video courses are final, and no refunds will be issued once the transaction is complete.

Mentorship Program

Participation in the Mentorship Program is subject to an application and selection process. A place in the program is only confirmed once the initial payment has been received.

The total fee for the 6-Month Mentorship Program is €3,950 plus applicable VAT.

Payment is made in two instalments:

• An initial payment of €1,975 plus applicable VAT is required to confirm and reserve the participant’s place.
• The remaining balance of €1,975 plus applicable VAT must be paid before the agreed start date of the Mentorship Program.

VAT will be applied where required by applicable tax law. Where VAT is not chargeable, including where the customer qualifies for a VAT exemption or where the reverse-charge mechanism applies, no VAT will be charged.

Cancellation and Right of Withdrawal

Consumers purchasing the Mentorship Program online have the statutory right to withdraw from the contract within 14 days of the date of purchase, where applicable under EU consumer law.

If the participant requests that the Mentorship Program or any personalised services begin during the 14-day withdrawal period, they expressly request early performance of the service and acknowledge that they may be required to pay for services already provided in accordance with applicable consumer law.

Once the statutory withdrawal period has expired, the initial payment is non-refundable. This is because acceptance into the Mentorship Program reserves a limited place that is no longer made available to other applicants.

If the participant chooses not to continue with the Mentorship Program after the withdrawal period has expired, the initial payment will not be refunded.

The remaining balance must be paid by the agreed payment deadline before the Mentorship Program begins. If the remaining balance is not received by that deadline, Stef Bastiàn reserves the right to cancel the participant’s place and offer it to another applicant. The initial payment will remain non-refundable, subject to any mandatory rights provided by applicable consumer law.

Program Delivery

The Mentorship Program combines recorded educational material with live and personalised services, which may include individual or group online sessions, personalised feedback, assignments, email support and other forms of direct guidance.

Specific dates, session frequency, program content and access arrangements will be communicated to the participant before the Mentorship Program begins.

All educational materials, recordings, videos, documents and other content supplied as part of the Mentorship Program are for the participant’s personal use only and may not be reproduced, distributed, shared, resold or made available to third parties without prior written permission.

7. Warranties for Digital Content (RDL 7/2021)

In compliance with current regulations regarding the sale of digital content and services, we guarantee that the digital courses and mentorship materials will be accessible and conform to the description provided at the time of purchase. We will provide the necessary updates to ensure the digital content remains secure and functional during the time it is hosted on our platforms.

8. Intellectual Property

All content included in the courses and mentorship program (videos, texts, graphics, methodology) is the exclusive property of Stefano Piterá and is protected by Spanish and international intellectual property laws. Purchasing a course or program grants you a personal, non-exclusive, non-transferable license to view the materials for personal use only. You are strictly prohibited from reproducing, distributing, modifying, or sharing the content with third parties without our express written consent.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law. In the event of any dispute or conflict regarding the interpretation or application of these terms, if the buyer is a consumer, the competent courts will be those of the consumer's place of residence, as mandated by Spanish law.
